Great, the Bush Admin. will use this as a stump to defend torture. "If we could have tortured Moussaoui back in August 2001 we would have been able to get all this info out of him and saved 1000's of lives, but those American-hating liberals don't want us to torture people." And people will buy it.

i am fully in favor of torturing terrorists in "ticking bomb" cases- that is to say when they are a known (not just suspected) part of an imminent threat and the information they have will save american lives if forced out of them. i do not, however, condone torturing anyone who even might be innocent or when the threat is of an unknown or speculative nature, so my criteria would not be met by this case,
