I saw some headlines but I have no idea what this is about.

I suppose I would have read the article if I cared even a little.

Re: No Noah in Penthouse, and Then Not and Lawsuit Thread?

Mets pitcher Noah Syndergaard allegedly signed a lease for an expensive apartment in Gotham, but didn't move in, what with the way things have been, and he allegedly hasn't bothered with his rent obligation.

you think he should've been forced to live in an apartment despite medically needing to be in Florida plus pandemic? seems cruel.

landlord is just pissed (do we know it's NOT the Wilpons?) that the rental market dried up. Otherwise he would've greedily accepted Thor's 50k and double dipped.

But if there's respite for the pandemic, it's likely going to benefit the landlord, not the renter.

He should have been forced to pay the rent he agreed to. What relief exists or should exist for lower and middle class renters in actual financial need is not the question here. These are two well-off people* neither one of whom need a taxpayer handout. Honor your contract. The law is VERY clear in these circumstances - it is the landlord's obligation once Noah tells him to find someone else to try to do so - and Noah is still on the hook for the difference if the landlord succeeds. The landlord also can't legally reject a qualified replacement tenant - so maybe Noah should reach out to all the other rich athletes who ARE in NY and find one.

*a presumption on my part that the landlord is well-off, but i think a fair one for anyone renting out $250k/year units.

I guess we shall see how the courts decide.

Renters should absolutely should have some protection from catastrophic things happening that prevent the agreement from even happening, nevermind two.

Is the "money hungry" landlord getting a respite from the mortgage on the building, the salaries he is paying on the staff to manage and maintain the building and the City of New York property taxes?

I have no idea who is at fault here and if the guy leaked it to the media to gain some leverage, that's a bad business move because word about that will get around. But to label all property owners as "money hungry" bad guys isn't right, either.

probably. this is a country run by and for rich people, and if you own a building like that, you're almost without a doubt in the 1%.

no doubt.

But at least he's an anti-trump democrat, so there's that. (I have no idea if he's in charge of having his company sue Thor for more than the total cost of the contract)

Re: No Noah in Penthouse, and Then Not and Lawsuit Thread?

I think what's called for is a two or three trillion dollar tax cut where 83% of the benefits go to the richest one percent. I wonder which scumbag political party that won't pass more stimulus for ordinary folks struggling in this pandemic passed that tax cut? Because poor folks and regular folks never get screwed a zillion times over.

Oh, those poor, poor rich people.

we better cut the healthcare payroll cost for these folk's too. Only way we can get the economy back on track with soft-opening and half-capacity type measures. Can't have them having to pay for the all those health risks their employees incur being ground up for another dollar.

Syndergaard has some sketchy living arrangements. I believe he and Gselly we're bro-ing together in one of those new West Side high-rises, and Syndy appeared in leasing advertisements for it, sure they gave him a sweet deal on rent for that

I've never understood the hatred for landlords in this city. All small business owners are lovable members of society who deserve a break. Until the point they buy that brownstone. Now they're instantly greedy and every dollar they get is basically stolen.

I get that there is a public housing crisis. That demands a public, not private, solution.

Lots of people are hungry during this pandemic. Should grocery stores give away food? Should they be prevented from prosecuting those that don't pay for their food?

Are they greedy for wanting to be paid the stated price?

Re: No Noah in Penthouse, and Then Not and Lawsuit Thread?

As for Noah, it sucks he hurt his arm and has to rehab in Florida. None of that is his landlord's fault. Offering to pay 2 months when you signed on for 8 is nowhere near fair or good faith.

Pay your rent.

Re: No Noah in Penthouse, and Then Not and Lawsuit Thread?

we'll see. If it was me and not Thor, and there was no pandemic, there's a huge chance the company (because it's a company, of course it's a company. it ain't some little old lady who's just happened to own the building forever) just takes the money and tries to rent it out.

This stuff is common place, hell I've done it. I don't remember the exact details but I lived in an apartment complex and begged out of my lease early when I bought a house. They accepted and we moved on. And then they yelled at me when I kept parking there to use the train. oops.

Re: No Noah in Penthouse, and Then Not and Lawsuit Thread?

I don't necessarily hate landlords. And from what little I know about this case, Noah should pay the rent. He got hurt after he signed the lease? Tough breaks. I say "what little I know" because I don't know the lease terms. And the lease sets the rules. Of course, the landlord is obligated to make a sincere good faith effort to find another tenant -- i.e., to mitigate damages. That's the basics.

My beef is with the defenders of the one percent -- you know, tax breaks for Betsy DeVos while working stiffs are supposed to work the cash registers in this pandemic for minimum wage while their bosses conceal the number of sick people they're co-working with and provide their workerswith with flimsy safety protection. They're just pieces of meat to be exploited so the people at the top could make the big bucks. It's Upton Sinclair's The Jungle all over again, as if it ever left.

And then this from the scumbag political party that should be taken out with extreme prejudice:

At this point it's almost a pathology. Whatever the crisis, whatever the state of the economy, Republicans crave another tax cut for the rich.

The latest proposal is for a temporary “holiday” on capital gains taxes, as White House adviser Kevin Hassett pitched Sunday on CNN and President Trump had earlier proposed via tweet. A one-time, temporary capital gains tax holiday would do little to stimulate the economy, even according to the GOP's usual line that tax cuts goose growth. The move could, on the other hand, permanently hobble the ability of future presidents to fund the government.

You signed a lease, you pay the rent until the lease is up. If you can't use the apartment, then try negotiating with the landlord for a reduced rent while he has a chance to re-rent it. This should be done quietly, but I get the feeling Noah was being a bit of a dick about it.

I saw Noah a few times walking around in Soho, in the Before Times. So he had to have a place nearby.

We just became landlords, not a great gamble on our part. We thankfully got the parents of our tenants to guarantee we get paid b/c making mortgage without their $$ would get difficult in a hurry. Two young 20 somethings, a gay guy and a girl. The girl split for Midwest mom and dad weeks ago. We think she musta lost her job.

Noah in the penthouse

Please don't sue!

Cause COVID-19

Ain't Wuhan Flu!

Can I take a little mulligan

with the lease I signed?

'Cuz Gotham is no place

for me to be confined.

Noah in the penthouse

Is a bad idea!

When I first saw the place

I thought, "O, fuck yeah!"

I can party with the chickz

All season long!

But I never could anticipate

How things went wrong!

Noah in the penthouse

Just did not work out!

First I tore my UCL

Now the season's in doubt

Can I sign a little merchandise

To make things right?

The law should not apply to me

I'm rich and white! (white-white-white-white-white-white)

Noah in the penthouse!

There's no Noah in the penthouse!

Noah made his offer two months ago, and suddenly now when (PANDEMIC!) they couldn't rent the place and risk a month of vacancy if they accept his money, suddenly it comes out. It's not Thor being a dick here. He didn't say anything until he was dragged through the coals over a very normal process of negotiation.

Sure, he's legally obligated to the contract, and I don't know if he told the group to fuck off when they didn't take the two months or when they came a-calling again and he just ignored it or what. Keep in mind he offered two months and this leaked like 1 day into the third month. This was surgical by the landlords. dick move.

So yeah, I'm firmly on Thor's "side" here, and hope he wins at least a reduced rate.

Because you can't whine to the media that Syndergaard didn't pay if he's offered you two months and those two months haven't expired yet. What if it got rented? Then you look even worse.

They asked for 80k+ on 4/17. If Thor is not lying about offering the 54k they're bickering over a month's rent. A MONTH. They claim he owes three, he offered two, so they sued for the whole amount + lawyer fees. Because they know he has it. How is that not money-hungry and greedy?

Also, if you send a letter saying "you owe us 80k" do you have the legal standing to then demand 250?
