The Justice Department has asked the Supreme Court to determine if Trump gets immunity.
Special counsel Jack Smith on Monday asked the U.S. Supreme Court to step in and quickly decide former President Donald Trump’s claim that he enjoys blanket immunity from criminal prosecution for actions taken while he was in the White House.
The aggressive prosecutor says the conservative-led top court should deliver a timely decision to avoid unnecessary delays in Trump’s explosive election interference trial that is now set for Mar. 4.
“This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office or is constitutionally protected,” Smith’s prosecutors wrote.
The move amounts to calling the bluff of Trump’s defense, which hopes to use a potentially lengthy appeals process to delay the trial if possible until after the 2024 election, when he hopes to regain power.

I assume it's dangerous because of the potential that the Court will rule that Trump does in fact have immunity.

Smith is doing this because a quick ruling will eliminate the stalling tactics that Trump's team is doing, where they're hoping to delay any trial until after Trump is once again in the White House.

If they rule he has immunity, it is his "Get Out of Jail Free" card. There will be no reason to continue the cases against him currently in Federal Court. (insurrection and document cases) And I'm not sure if he could claim immunity in the Libel and NY business cases.

But Smith's move isn't dangerous. If Trump loses in the Circuit Court, he'll appeal to SCOTUS and they'll most likely hear the case anyway. All Smith is doing is moving to expedite the decision. Because a Trump loss that takes a long time to decide could still be a loss for Smith. Smith isn't making it any more dangerous for himself or the Gov't. and prosecution by asking SCOTUS to take this appeal directly from the Disctrict Court and on an expedited basis.

Boggles my mind that justices appointed by a President can rule on cases involving that President. How is that not a conflict.

There isn't anything the law provides to remedy the situation.
Thomas can rule on a case in which his wife is somewhere between an interested party and a defendant( or both).
He should recuse himself, but won't.

I'm very much against this. It'll be overturned by the Supreme Court in a jiffy.

This only feeds into the persecution complex that Trump radiates. "They're out to get me, look what four deranged judges in Colorado did!" This will only incite the crazies; those judges better have 24/7 protection for the next few years, or longer if he's elected. It'll also mean he'll win the Colorado primary going away, as he probably would have anyway.

You beat a person at the ballot box, not in a courtroom.
